REGARDING ALLOCATION OF LIMITS FOR COMMERCIAL FISHING for roach, perch,
crucian carp, pike, bream, tench, redeye, zander, zool bream IN STATE AND
LEASED LAKES, PONDS AND KAUNAS LAGOON

We are writing this letter to you when the COVID-19 pandemic devastates and
continues to ravage and when the world’s leading scientists, specialists and
politicians explain that an even stronger wave of the COVID-19 pandemic may
come.
Since the beginning of the pandemic, world leaders and politicians have
taken the most active steps to stop the movement of people, indoor training
for schoolchildren and students, tourism, sports and artistic events,
religious services and business have stopped – STATES STAYED IN ISOLATION
BETWEEN THEIR BORDERS.
For this occasion, I had prepared information on the state of fishing in
Lithuanian lakes and ponds and posted it on the website www.ficheryabc.eu
However, due to the announced corona virus, the conference in Vietnam was
canceled.
On 23.02.2020, I sent this information to the approximately 600 electronic
addresses of Lithuanian institutions, including the President, the Speaker
of the Seimas, the Prime Minister, members of Parliament, the Government,
politicians, specialists of associations of fishermen, fishermen,
specialists of fishing regions, amateur fishermen associations. In that
document, I would set out very briefly the situation that no limits have
been issued for commercial fishing in lakes, Kaunas lagoon and ponds since 1
January 2015. I REMINDED that since the beginning of the world,
entrepreneurs have been allowed to fish in lakes and ponds. I NOTED that
leaders from all over the world are promoting small-scale fishing business
and the sale of fresh fish.
Therefore, once again, we kindly ask to ALLOCATE limits for fishing of
roach, perch, crucian carp, pike, bream, tench, redeye, zander, zool bream
in 35 state water bodies, in Kaunas lagoon, ponds at least at the level of
2012 and REJECT the draft project of the Law on Fisheries of the Republic of
Lithuania. PLEASE CREATE WORKPLACES FOR COMMERCIAL FISHERIES, REDUCE
UNEMPLOYMENT AND SOCIAL SEPARATION IN LITHUANIA.
This is a concise summary of the thoughts that have been presented since
2007 in about 140 letters to Lithuanian leaders, politicians, responsible
institutions, and the mass media.
A. ALLOCATION OF LIMITS AND STATUS OF FISH RESOURCES
Limits for commercial fishing are allocated in accordance with the Law on
Fisheries of the Republic of Lithuania, which states that commercial fishing
is permitted in accordance with the data of fisheries research in inland
water bodies larger than 200 ha. There are 99 such state water bodies.

IT SHOULD BE NOTED that lake tenants have not had
the right to catch any fish with commercial fishing gear since 01.01.2015,
as they will be punished. These bans are very detrimental to the
organization of rural tourism, as Lithuania is a land of lakes: there around
3000 of lakes, 1500 of ponds and around 29 thousand of rivers, streams and
canals.
On 29.06.2016, Lithuanian Fisheries Council, established as an advisory body
by the order of the Ministers of Agriculture and Environment, which includes
the most prominent scientists in the field of fisheries, including 3
Lithuanian scientific laureates, representatives of ministries and the State
Food and Veterinary Service, leaders of fisheries, fish farming, fisheries
regions, fish processing and of fishermen’s associations, and the most
famous fisheries specialists STATED: The condition of fish resources in most
of the studied water bodies is good, only condition of 10% of water bodies
is poor or moderate; Use fish resources rationally, using only about 50
percent of fish stocks for recreational fishermen.
. The recommended catch limits for the production of the recommended fish in
the 68 researched water bodies exceeding 200 ha, total area thereof
amounting to 41,463 ha, are the following: Perca fluviatilis: 142,627 kg,
which constitutes 16.33 percent, Carassius carassius: 7,836 kg (0.9
percent), Esoxlucius: 23,864 kg (2.73 percent), Tinca Tinca: 33,946 (3.89
percent), Abramis brama: 126,876 (14.53 percent), Sander lucioperca: 9,627
kg (1.1 percent), Rutilus rutilus: 270,390 kg (30.97 percent), Blicco
bjoerkna: 94,419 percent (10.81 percent), Scardinius erythroph thalmus:
13,035 kg (1.49 percent), other fish: 150,570 kg (17.24 percent), total:
873,190 kg. We hereby attach the recommended catch limit table (see Chapter
6 on the website)
On 07.04.2017, Minister of Environment K. Navickas provided the information
that in 2011–2016, the total fish biomass in the 384 lakes and ponds
researched increased 1.5 times while the average fish weight increased 1.3
to 1.4 times
IT IS A PARADOX - fish biomass increased 1.5 times in 2011-2016, but this
does not allow entrepreneurs to fish in lakes since 01.01.2015.
IT IS KNOWN that about 10-20% older fish die naturally every year. Some of
their entrepreneurs could catch up and bring to market.
The state allocates about 8 million euros annually for the administration,
conservation, research and reproduction of fish resources every year. The
state-maintained 7 fish breeding companies breed fish in lakes, rivers and
ponds. However, lake fishermen entrepreneurs are not allowed to catch any
fish. This means that Lithuanian leaders and politicians have special
respect for amateur fishermen, BECAUSE MORE VOTES ARE EXPECTED FROM THEM IN
THE ELECTIONS THAN FROM FISHERS-ENTREPRENEURS.
IT SHOUND BE KNOWN that fishing in lakes, with a limit of about 3 tons,
lasts about 3-5 months and can add about 20-30 percent to the fisherman’s
budget. Many fishermen entrepreneurs own their own homesteads in rural areas
and are engaged in agriculture, business, tourism and render services.
All this information confirms that commercial fish stocks were abundant. Due
to the fact that no limits have been set for commercial fishing in lakes
since 1 January 2015, fish stocks have further increased. Knowing that the
number of people in Lithuania has decreased, and teenagers and
schoolchildren are less and less interested in recreational fishing, because
they spend their free time on computers and mobile phones, this has
significantly increased fish stocks.

REGARDING COMMERCIAL FISHING IN INLAND WATER BODIES
The Ministry of the Environment, having analysed your letters of 1 May 2020,
14 May 2020 and 22 May 2020 regarding commercial fishing in inland waters,
informs that specialized fishing for vendace, smelt, river lamprey and
migratory eel is allowed in state inland waters in accordance with the
procedure established by the minister of environment. Other types of
commercial fishing are allowed only in the Curonian Lagoon, lower Nemunas
polders and private inland water bodies. We believe that this is a rational
and well-formulated provision, the arguments of which have been presented to
you several times by the Ministry of Environment in letters during the
period of 2016-2019.
Research reports on fish stocks in state inland water bodies can be found on
the website of the Ministry of Environment www.am.lt under the heading
“Areas of activity” - “Nature protection” - “Fishing” and on the website of
the Environmental Protection Agency gamta.lt under the heading “Publications
and reports” – “Research reports”.
We remind you that Clause 12 of the Rules for Examination of Applications of
Persons and their Service in Public Administration Institutions, Bodies and
Other Public Administration Entities, approved by the Government of the
Republic of Lithuania under the Resolution no. 875 of 22 August 2007 “On the
Rules for Examining and Serving Applications of Persons in Public
Administration Institutions, Bodies and Other Public Administration Entities
and Approving the Form of a Request, Complaint or Other Document Confirming
the Fact of Admission”, provides that an application submitted by the same
person within one year on the same question which the institution has
already examined and answered, or, if it appears that the same matter has
been addressed by a court, shall not be re-examined unless new circumstances
giving rise to the request are identified or additional arguments are
presented causing doubts on validity of the previous answer.
This decision may be appealed to the Central Commission for Administrative
Disputes or the Vilnius Regional Administrative Court in accordance with the
procedure established by the Law on Administrative Proceedings of the
Republic of Lithuania not later than within 1 month from the date of receipt
of this decision.

IT IS KNOWN that the Presidency, the Seimas and the Government employ highly
qualified specialists, lawyers and fisheries experts with extensive
experience. It is probable that they pointed out that the Ministry of
Environment exceeded the deadline for submitting a response by 3 weeks (the
letter of 1 May 2020 was answered on 23 June 2020). They probably noted that
one letter responded to 3 letters (to the letters of May 01, 14 and 22). The
reply does not provide any information regarding the request dated
01.05.2020: “WE REQUEST TO ALLOCATE LIMITS FOR commercial fishing for
fishing roaches, perches, crucian carps, pikes, breams, tenches, redeyes,
zanders, zool breams in state and leased lakes, ponds and Kaunas Lagoon for
2020”. EVERYONE KNOWS that the limits for commercial fishing are set in
accordance with the Law on Fisheries of the Republic of Lithuania, which
clearly states that commercial fishing is allowed in accordance with the
data of fisheries research in inland water bodies larger than 200 ha.
Employees of the Presidency, the Seimas and the Government probably pointed
out that according to the same law, limits were set until 1 January 2015. It
should be noted that during the last five years, according to scientific
research, commercial fish stocks were abundant, as on 07.07.2017, K. Mažeika,
Minister of Environment explained that the fish biomass increased by 1.5
times in the 384 lakes analyzed in 2011-2016. There were no FORCE MAJEURE
circumstances in Lithuania, therefore there should be no reason to prohibit
commercial fishing in lakes, Kaunas lagoon and ponds.
We are convinced that the responsible employees informed the President, the
Speaker of the Seimas and the Prime Minister about the letter of the
Ministry of Environment, as we have not seen such a vague, twisted and
evasive answer before.
C. HISTORICAL CONTEXT
WE INFORM YOU that the responsible authorities, politicians and officials
HAVE NOT RESPONDED to our letters for the past 10 years.
NOTING that as the Lithuanian authorities did not respond, we addressed the
responsible institutions of the European Union and the leaders of states of
the world:

Honourable Sir QU Dongyu, Director General of Food and Agriculture
Organization of the United Nations, we remind you that we wrote a letter on
03 June 2019 to José Graziano da Silva (see Chapter 9 on the website)
On 2012-12-10 I and four closed-system fish farming of Lithuania
representatives and a member of the European Parliament Juozas Imbrasas had
the honour of meeting the European Comissioner for Maritime Affairs and
Fisheries Maria Damanaki. The comissioner explained that the global fish
stocks are depleted because human population is rapidly increasing while the
fish populations are declining. She said that the European Union is focusing
on sustainable fishing, closed-system fish farming and initiatives in
fishery science. She explained that the European Union provides funding for
good projects.
In 2007-2013 around 70 percent of the European Union provided funds for
pisciculture Lithuania granted to investment groups of Kaunas and Raseiniai.
In Nida and Juodkrantė fish loading ports were installed where still not one
kg of fish has been unloaded. In Klaipėda after demolishing more than 10
years ago built auction financed by european funds, a new fish production
auction was built for nearly 1,5 million euros, adding around a million
euros to save the auction – it was sold for around 300 thousand euros. These
are examples of modern exploitation practices of the European Union grants.
The time period coming to an end, barely įn 2 years a couple of months ago a
business plan in ECHEL format was arranged. Local regional fishery groups in
lakes have not been granted any funds because commercial fishing in lakes is
prohibited. PARADOX – local businessmen fishermen ARE NOT ALLOWED to catch
not one fish. The government and politicinas know very well GRANTED EUROPEAN
FUND RETURNS constantly demonstrating PRIME EXAMPLE of how to CAUTIOUSLY
DISTRIBUTE THE EUROPEAN FUNDS.
Lithuania’s leaders and responsible institutions know about possibly
uneffective, non-transparent and corrupt use of EU funds, and in the summer
of 2016 it was reported to the President of the European Commission
Jean-Claude Juncker, The European Anti-Fraud Office (OLAF), ECA – European
Court of Auditors.
People say that everyone is afraid to tackle these problems because
Lithuania might be forced to return a lot of euros to the European Union.

ADDRESSING TO THE RESPONSIBLE INSTITUTIONS OF THE EUROPEAN UNION AND THE
LEADERS OF STATES OF THE WORLD, we also addressed the documents to the
leaders, politicians and responsible institutions of Lithuania.
IN THE LETTERS AND ANNEXES, WE HAVE WRITTEN AND EXPLAINED: about Lithuania,
about legal norms and their violations, fish resources, circumstances of
setting the limits, despise and insults on fishermen.
On 11 March 1990, Lithuania regained its independence.
About 2.8 million people live in Lithuania, the territory covers 65.3
thousand sq. km. There are 2621 sq. kilometres of inland water bodies -
about 3,000 lakes, about 1,500 ponds and about 29 thousand of rivers,
streams and canals and the Curonian Lagoon.
We explained that commercial fishing is regulated by the Law on Fisheries of
the Republic of Lithuania, which states that commercial fishing is allowed
in accordance with the data of fisheries research in inland water bodies
larger than 200 ha. There are 99 such state reservoirs.
We explained that from 01.01.2013 in Kaunas Lagoon, and from 01.01.2015 in
state lakes and ponds WITHOUT SUBMISSION OF ANY ARGUMENTS, entrepreneurs are
not allowed to catch roaches, perches, crucian carps, pikes, breams, tenches,
redeyes, zanders, zool breams.
The Ministry of Environment, some of the politicians and state officials, as
well as amateur fishermen, usually justify the refusal to fix limits for
commercial fishing with the fact that commercial fishermen exhaust the water
bodies and engage in poaching, that not enough fish is left for amateur
fishermen, and that the businessmen disturbs the fishing for the amateurs.
It should be clear as day to anyone that such malicious disregard for the
businessmen has no basis as never have scientists identified a single water
body as having been exhausted by commercial fishermen, nor have the latter
been found guilty of pouching. A person of a sane and sober mind should be
able to realise that the businessmen, fishing in the 13–35 aforementioned
water bodies, could never exhaust the entirety of over 33,000 water bodies.
The Ministry of Environment has also imposed a ban on commercial fishing for
the lessees of water bodies. We draw you attention to the fact that that all
citizens of Lithuanian pay taxes to the budget; therefore, they have the
right to purchase fresh water fish of Lithuanian origin (Rutilus rutilus,
Perca fluviatilis, Carassius carassius, Esoxlucius, Abramis brama, Tinca
Tinca, Scardinius erythroph thalamus, Sander lucioperca and Blicco bjoerkna).
Nonetheless, the Ministry of Environment continues to prohibit commercial
fishing.
In all the letters, we asked to allocate the limits for lake
fishermen-entrepreneurs.
Lithuania’s leaders and politicians are delighted that for 6 years
businessmen have not been allowed to fish in lakes and that they are
forbidden from making a couple of hundreds of euros per month. They do not
care that community is in the lack of low-priced fish in the market.
D. OBJECTIVES OF THE REFERENCE
Honourable leaders of the European Union institutions and the countries of
the world, we wrote you letters informing you about the essence of the Law
on Fisheries and actions, the state of fish resources, adding summary tables
and the fact that in our opinion Lithuanian institutions are behaving
illegally:
We are sending this letter to the leaders of the European Union institutions
and the countries of the world, because we have previously informed you
about the abuses of lake fishermen-entrepreneurs.
We will send this letter to the countries of the world with which Lithuania
has diplomatic relations.
We will try to send this letter to other countries as well, because you
cooperate with them.
This letter will be distributed to the Lithuanian institutions and people.
Our goal is for the WORLD to find out about the illegal and immoral actions
of the President of Lithuania, the Speaker of the Seimas, the Prime
Minister, the Presidency, the Seimas and the Government, politicians and
institutions, because commercial fish resources are abundant, but Lithuanian
fishermen-entrepreneurs are not allowed to catch fish in lakes by the
government of Lithuania.
We hope that you will help Lithuanian leaders understand about the despising
of lake fishermen entrepreneurs for more than 10 years, violations of the
Fisheries Law and great harm to entrepreneurs, when leaders around the world
encourage commercial fishing in lakes and sell fresh fish, and Lithuanian
leaders forbid it.
WE REQUEST the President of the European Commission, Ursula von der Leyen,
to accept our representatives for an interview.
WE REQUEST the President of the European Council, Charles Michel, to accept
our representatives for an interview.
WE REQUEST the Honourable Member of the European Commission for the
Environment oceans and fisheries, Virginijus Sinkevicius, to help addressing
issues and setting limits for lake fishermen entrepreneurs.
WE REQUEST the honorable QU Dongyu, Director-General of the Food and
Agriculture Organization of the United Nations, to help resolving issues and
setting the limits for lake fishermen entrepreneurs.

To help us to resolve issues regarding the allocation of limits to lake
fishermen entrepreneurs and to give us the opportunity to explain the
current situation to your ambassadors accredited in Vilnius.
WE HOPE that the leaders of Lithuania WILL UNDERSTAND THEIR GUILT and
LONG-TERM ABUSE of laws and will grant limits for fishing for roaches,
perches, crucian carps, pikes, breams, tenches, redeyes, zanders, zool
breams in state and leased lakes, ponds and Kaunas Lagoon, WILL APOLAGIZE TO
THE VICTIMS AND COMPENSATE THE DAMAGE.
WE ARE WRITING ONE LETTER TO YOU ALL, but we hope everyone will read and
give us their opinions and suggestions, because no fisherman in the world
has been subjected to such huge bans and massive despising and insulting so
far. Mankind remembers the times when the Bolsheviks, Nazis and Fascists
massively despised, persecuted, and annihilated individual social groups.
WE RECALL that the policy performed in Lithuania has many important negative
features: Lithuania is the world leader in terms of alcohol consumption per
capita. Lithuanian average earnings are one of the lowest in the European
Union, about 25 percent of the Lithuanian people live below the poverty
line. According to the research of the Lithuanian Special Investigation
Service, in 2014, the Seimas of the Republic of Lithuania took the SECOND
PLACE among the most corrupt institutions in Lithuania. Lithuanians do not
trust the Lithuanian Parliament the most in the European Union.
In the fight for COVID-19, Lithuania has prepared a grandiose action plan
and has already allocated about 4 billion euros. Another EUR 2 billion is
planned to be distributed. Nowhere, however, was presented any plan to
revive the age-old fishing business in the lakes and to allow about a couple
of hundred fishermen and their families to take part in it.
WE DECLARE CATEGORYLY that NO CENT IS NEEDED for additional funds from the
European union and the Lithuanian budget to restore the fishing business in
lakes.
Once again, we state that commercial fish resources are plentiful. Pay
attention to the tables provided and the assessments and statements of
scientists and specialists.
It is impossible to ascertain why in the ONLY state of the WORLD, in the
absence of FORCE MAJEURE circumstances, Lithuanian leaders, government and
politicians do not allow entrepreneurs to catch roaches, perches, crucian
carps, pikes, breams, tenches, redeyes, zanders, zool breams and ARE GOING
to enforce all the bans by law No. XXXP-1205.
On 18 June 2020, in his annual report to the Seimas, the President of the
Republic of Lithuania Gitanas Nausėda spoke: “… It is a shame that we have
lowered the level of political responsibility of high-ranking government
officials to the bottom. Meaning, all actions that are not punishable by
imprisonment are legal and lawful. There is no way we can solve the
long-standing problems, because we are not looking at what is being offered,
but at what is being offered…”
The President acknowledges that we have LOWERED the liability level to the
bottom. We understand the President’s interpretation that commercial fishing
in lakes is banned by politicians, ministers and members of government
because by those bans they expect more votes from amateur fishermen in
elections. We presented information to everyone that commercial fish stocks
are plentiful. However, leaders and politicians do not take this into
account at all. It is impossible for fishermen-entrepreneurs to fight
against the Lithuanian political and government conglomerate in the courts.
For 6 years, Lithuanian leaders and politicians have been committing a group
crime against the social group of commercial lake businessmen, disregarding
and impoverishing them. Such crimes are referred to in the LEGAL PRACTICE as
GROUP CRIME.
At the time of Covid-19 pandemic in the Parliament are being discussed the
issues of the law Nr. XXXP-1205 to ban commercial fishing in lakes, Kaunas
reservoir and ponds because the parliamentary elections are approaching
(October 11th) and the politicians need more votes from amateur fishermen.
The President G. Nausėda is preparing to implement the PROJECT FOR WELFARE
STATE, but he did not respond to the requests of businessmen and scientists
of 2 lakes to accept for the meeting.
As of June 23, 2020, neither the President, nor the Speaker of the Seimas,
nor the Prime Minister informed us about the response of the Ministry of
Environment and the setting of limits. THEREFORE, WE REQUEST ONCE AGAIN TO
ALLOCATE LIMITS FOR COMMERCIAL FISHING IN STATE AND RENTAL LAKES, PONDS AND
KAUNAS LAGOON for roaches, perches, crucian carps, pikes, breams, tenches,
redeyes, zanders, zool breams and to prevent fishing bans on lakes from
being legalized (No. XXXP-1205).
